Is the first sentence of the 5th amendment not part of the constitution?
4
Colorado's Supreme Court wrote a stay into the decision. The moment the SCOTUS appeal is filed, this decision is null and void, and Trump must appear on the ballot even without a SCOTUS ruling. Filing the appeal is all that's necessary. Hope you enjoy the new headlines, that's all this is.

None. The moment the SCOTUS appeal is filed, this decision is null and void. The court wrote a stay into their decision. Enjoy the news headlines, that's all this is.

@cindydott452 Conviction requires a unanimous decision by a jury. Juror pools are based on registered voters. Even in the bluest of districts, there will be a Trump voter on the jury. There will never be a unanimous decision.

The first sentence of the fifth amendment is very clear too.

Democrats are going to lose their mind when they learn about the stay written into the decision. The moment the SCOTUS appeal is filed, this ruling is null and void. Enjoy the news headlines, that's all this is.

So you want abortion to be legal at the federal level, but you don't want the Presidential election at the federal level. How logical...
1
The fact you think the Department of Justice and the Judicial Branch are the same thing is laughable and sad. Take a civics class.
1
So, the federal government should recuse themselves from federal elections...? How logical
1
So, you don't want felons to be able to vote? Or is this another one of those contradictions progressives like to make?

Would you support moving his criminal trials to 2025? Or are you terrified he might win, and you want to use the DOJ to subvert democracy and prevent him from possibly winning?
1
"Who voted in the minority"... Justices don't vote. There is no minority in a court of law. There were three justices in dissent... It's ok, you tried your best to make it seem like you know how any of this works.

@gliocasneko Aid or comfort...? So now you are pretending Trump passed out bottles of water at the Capitol?
1
@Pete...NoNotThatOne "The only punishment under 14-3 for.... participating in insurrection" See, that is answering for an infamous crime.... Now, what does the first sentence of the fifth amendment say? Come on, quote it don't avoid it.
1
@gliocasneko How does a pardon, years later, assist what's already occurred in the past? See, you're stretching to make your argument work. That's how we all know it's BS.
1
@gliocasneko Aiding and abetting is a crime. No governor or president has ever been charged with aiding and abetting due to a pardon they have issued. Try again. Or maybe try reading the court documents and understand they are not arguing that the 14th applies in the way you are claiming. Your intellectual laziness is showing.
1
@gliocasneko Yes, you are correct, and the legal experts in Colorado clearly have no idea what they are talking about. Clearly, you know better than the legal experts. That's why they didn't argue what you're claiming... Regardless, the first sentence of the fifth amendment will still apply. And given the stay the Colorado Court wrote into the decision, Trump will be on the ballot in Colorado. Enjoy rambling on about things no legal expert is claiming. It definitely doesn't make you seem confused and crazy at all.
1
@gliocasneko What does the first sentence of the fifth amendment say? Come on, don't avoid it, quote it.
1
@gliocasneko No, you don't understand. You don't understand that regardless of comfort or whatever nonsense you want to believe... Answering for an infamous crime requires a jury decision.
1
@gliocasneko Absolutely nothing you are arguing, is being argued by legal experts... Why is that? Why are the legal experts not arguing what you are? Is it perhaps because you are wrong? Or do you know more than the legal experts?
1
@gliocasneko Colorado wrote a stay into their decision. The moment the SCOTUS appeal is filed, the Colorado ruling is null and void. Even if the Supreme Court does not hear the case before the primaries, Trump will have to be on the ballot. This entire ruling is for the sake of news headlines, it's just political theater for low information voters like you.
1
@UlassG Inciting an insurrection against the US... Wow, that sounds precisely like a infamous crime. Now, what does the first sentence of the fifth amendment say? Come on, quote it don't avoid it.
1
What does the first sentence of the 5th Amendment say? Stop cherry picking the parts of the constitution you want to apply to the situation.

Colorado decided to ignore the first sentence of the 5th Amendment.
1
@TheSeventhOutlaw Aww, don't avoid reality for the sake of your political tribalism.
1
@Synodalian You're asking the difference between the various branches of government. The Presidential oath and Constitutional oath are not the same thing, because the people reciting them serve different roles in relation to our government and the constitution. Do you think a Senator should take the Presidential oath?
1
@Synodalian The head of our government is the President. An insurrection, by definition, overthrows the power of a government. In what world does it make any logical sense where a President overthrows himself? Your lack of understanding of what these words actually mean has caused you to parrot what you've heard political commentators say. People like David rely on your ignorance to not question the narratives they feed you.

Aren't those two known for removing their opponents from ballots...?
