Section 3 of the 14th Amendment is not the only part of the Constitution that exists. In fact Section 1.3 of the 14th Amendment requires due process when abridging a privilege of citizenship, such as holding government office. The due process for proving guilt is clearly stated in the 5th and 6th Amendments, establishing the requirement of a jury.
