  4. To be specific. He needs a license from the Corporation who owns the AK IP. Then he can make his AK 50 without liability, as a product rather than as a modded gun. After that. Yeah, he needs a Copyright and a Patent Lawyer. Not really a Trademark Lawyer because AK is already TM by the IP Holder. You can get a license or a disclosure contract for the TM. If you're going to put AKs into your game (in America), then this is the legal step. Because for Video Games, it's Copyright Law and not Patent Law. Patent Law doesn't apply to virtual art such as a 3d gun model.

Unless there is hard evidence of False Advertising and not out of FEELING... Then you have your case to actually win. Yes, in America, you can sue for any reason but actually winning the lawsuit is another story. In the end, don't go sueing a corporation for what criminals use to do the crime.   13. It's illegal in America to take a design and claim that as your own. Remember... The Government can not own a copyright because all copyright able works by the government is Public Domain instantly. But as a private person or company. If you didn't sign away your Copyright. You own the IP until you sell it or 170 years for corporations / life +70 years for one individual, passes.

They only oversee the lawsuit then judge on it, with or without the Jury. Anyone can sue for any reason in America. It's winning the lawsuit which is not as easy to do, in good faith. The same is also warned about if you take any USA Gun and stick into your game. You must find the IP Holder of any military gun (usually a private company) and pay for a license. The USA Government can not legally own any Copyright as all Government related Copyright is Public Domain. That said... Activition broke the law but corporations are above the law when Justice is payed for, rather than upheld. (This is a Copyright case because COD is a video game. Not a real event.) If another company tried to make the real AK 50, then that would be both Copyright and Patent infringement in America.

The original model of the AK is either copyrighted by a military company or in the public domain by now. Patent Law could apply to the AK 50 but it has to be novelty or extremely unique to qualify. Trademark law wouldn't apply because again... AK 50 is just a modded gun from the base model.

This is unlike USA Trademark Law where you have to defend it when you see Infringement. I don't know what country you got that version of Copyright Law.

Like getting sued for Copyright Infringement by Activition for the AK 50 when you're the original creator and the sole IP Holder of the real AK 50.
