Section 5 states that the use of words or behaviour or the writing, sign or other visible representation' must be 'threatening or abusive' or 'within the hearing or sight of a person likely to be caused harassment, alarm or distress thereby." So this woman by simply being there and close enough was entirely subjectively able to claim an offence was being committed? Is that correct?

Yep. The situation is fast becoming untenable and I feel sorry for the police in these circumstances. FoS needs to become an absolute. Not because it's the ideal but because the alternatives, as we are regularly witnessing now, are far worse, subjective and far more open to abuse by both individuals, groups, organizations and the state.

This unfortunate policeman and his peers are in an invidious position forever forced to try and define the indefinable on the fly according to ever varying circumstances. Freedom of speech needs to be enshrined in this country's 'constitution' and we need to work back from that point not from the vague daft forever shifting subjective position we find ourselves in today.
