  3. The 1917 US Espionage Act is notorious for being almost impossible to defend against. It is the State's ultimate blunt weapon of choice both to punish and 'pour encourager les autres'. The Act does not allow for such defenses as public interest, whistleblowing, exercising of First Amendment Rights or over-classification of documents.
