Not so. In the sense she is guilty. If you drank and a person crossed the centerline, that person entirely sober, you were driving correctly. The 100% proximate cause of the accident is the sober driver's fault. There is no contributory neglegence on the part of the driver who drank just because the person drank.

If you are drunk and simeone crosses the centerline and hits you the proximate cause of the accident lies entirely on the sober person who crossed the centerline.
