  2. Because they couldn’t prove he murdered anyone. The DA assumed that if he could get a conviction of tampering with a corpse he could get him on murdering the person. The defense made the DA try them both at the same time. When he was found guilty of tampering with a dead body (a misdemeanor), they couldn’t convict him of Murder. The way the law was written, you can’t get a capital crime from a misdemeanor one. All because of the way the DA tried the case. As such, they could not try him for murder because he had already been convicted of the misdemeanor at the same time and that one was first. So they lost their chance to try him for murder. Had they not tried them at the same time, they could have. I don’t know the exact wording that was used back then, a lawyer might. The DA made a stupid mistake when going with the misdemeanor first.
