  2. I believe this guy got caught robbing the man. The man tried to stop him and got killed for it. Was it first degree murder? I don’t think so. Looks more like a motive of opportunity. Unless NY sees the act of planning a robbery and someone gets killed during it, premeditated even though it was not part of the plan.
