Just because he was good at it, the police knew it was him but couldn’t prove it until the camera footage. That kind of planing I’d what makes him dangerous. They let him go and he will move on to another part of the country. He probably has other locations and only targets NY on the holidays. The lawyers just says he is not a danger because of his age.
