  1. Why say something when you can just as well say nothing? Why open yourself up to an allegation and a further prosecution if the prosecution, as in this case, is the punishment?

  2. As far as I know people in America have a Constitutional right not to be forced to testify in their defense. Something to do with the right to be presumed innocent until proven guilty. So, I’m not really sure what sort of point David Pakman thinks he’s trying to make here other than he wants to turn the law on it’s head and trust that his audience is too dumb to notice.
