  1. I disagree with Marcia on the Karen McDougall payment. She said that it is relevant because it establishes a pattern. You can’t establish a “pattern” with just one instance.

But, if Trump wins the election, Judge Chutkin would be trying the President Elect in a case that he will order his DOJ to dismiss as soon as he is sworn in, so it would make far more sense for Judge Chutkin to defer the trial until after the inauguration. Less chaos for the country that way also.

  3. Disagree with Geragos - I think that determining what is within the scope of presidential action (as opposed to private action) is a legal issue. I think the judge would look at the charges in the indictment, and then determine which of those are presidential and which of those are private. Like the equivalent of a motion for summary judgment/adjudication of issues in a civil case. Then, part of the case would likely be ordered dismissed, and part of the case would proceed.
