These boys were adults at the time. I just don’t buy the idea that they were so afraid of their parents that they had to kill them, but they weren’t afraid enough to just move out.

And she doesn’t just let people say things without actually explaining what they are talking about. I’m a retired attorney, but a lot of people need more explanation to understand the issues, and that’s great for her to do.

I think that Geragos said that the Melendez’ brothers weren’t allowed to have a jury instruction on the legal issue of their defense, which would have given the jury the rules for how to consider the evidence and how to evaluate it. Even if the evidence was allowed to come in, as the DA contends, without a jury instruction the jury wouldn’t have had instructions on how to deal with it.

It used to be that the death of an adult child really didn’t have any lawsuit value for the deceased’s parents. Absent special circumstances, like the adult child was the sole support for the parents, or the adult child worked in the parents’ business and was an integral part of it, the parents really wouldn’t be able to recover much money for the loss of the adult child. Even punitive damages seem questionable when these parents had so little relationship with their adult child. How did they possibly suffer from this loss?

I think that the problem is the pile on. It seems that he is a terrible person, and did some horrible things. But, that doesn’t mean that all of his “accusers” are telling the truth or that they were actually harmed.

The only point that Arthur Aidala is actually making when talking about the Menedez case is that you are never going to get consistent results for the same crime. Because, the facts of every crime are different and the juries, judges, attorneys, and defendants in every case are different. All we can really do is make certain that the law is consistent for every defendant.

@werocktheplanet That’s not the point I am making. Each accuser’s claim needs to be individually evaluated. But the media has a tendency to act like, and report as though, all of the accusers are telling the truth.

I think in the Chauvin case, he has already lost in the state case (and even lost the appeal), but what is pending now is a federal case alleging a civil rights violation.

@ZZ_The_Boxing_Cat If the abuse allegations were true, I’m sure they would have needed therapy. But I’m not sure they were true. And, killing both parents wasn’t a justified solution.
