  2. If piracy doesn't affect the publishers' profits the publishers wouldn't be paying their lawyers to stop it, though their case is weaker for works they don't actively sell. The justification for allowing something like copyright is that it is supposed to encourage production to and access to intellectual and artistic work. When the use does the opposite, the law needs an update.
