Comments by "Terje Oseberg" (@terjeoseberg990) on "Fmr. SEC chair: There's enough questions around Musk's go-private tweets we'd need answers for" video.
A Alvarez, Musk's tweet barely moved the stock. Most of the rise in the stock price occurred nearly 45 minutes BEFORE Musk's tweet, AND the trajectory was unmodified by his tweet. So unless the stock market somehow predicts the future, the rise in stock price that day had absolutely NOTHING to do with Musk's tweet.

A Alvarez, Why don't you tell me exactly what time the stock first started to rise? What the price was at that time? Then what was the price right before he sent his tweet? And what was the price when they stopped trading?
1
A Alvarez, So you're saying that you have no clue? I would think that since you're such an expert on Tesla you'd know already.

A Alvarez, Ok. So I'm full crap. Prove it by telling everyone who might read these comments exactly what time the stock first started to rise? What the price was at that time? Then what was the price right before he sent his tweet? And what was the price when they stopped trading?

A Alvarez, Here's the series of events. 6:30 am - The stock opened at $343.61 12:10 pm - The stock is $342.50 12:15 pm - The stock first starts to go up. 12:45 pm - The stock is at $355.11 12:47 pm - Elon Musk sends his tweet. 12:50 pm - The stock is now $371.15 12:55 pm - The stock has falling back to $357.10 2:10 pm - Trading stops at $367.25 So, the stock started going up 35 minutes before Musk's tweet and went up $10. Then immediately after his tweet there was a short blip of $15 for less than 5 minutes. Then it went back down to about $2.00 above where it was before his tweet. Then it slowly went up for the next hour before they stopped trading at around 2:10pm. Whatever happened at 12:15pm is the real reason the stock went up on Tuesday. All Elon's tweet did was create a short blip in the price. That blip was probably because it took people a few minutes to realize that, "considering" doesn't mean he's already decided and it's therefor definitely going to happen. Yeah, he shouldn't have tweeted that during open trading. He should have waited until after the market closed. But, I haven't heard anyone say that it's illegal for a CEO to tweet what they're "considering" during trading hours.

A Alvarez, The $420 price was set at a 20% premium in order to encourage people who are investing in Tesla for short term gain to vote "Yes" to go private, and to encourage them to sell their shares so that they don't participate in the long term gains that Elon is hoping for. There's nothing more to it.

A Alvarez, The SEC will determine whether he lied or not. You nor I have a clue what happened, nor do we have any clue what was going through Musk's mind when he sent that tweet. For some reason you're hoping that he lied because you want him to get in trouble. You probably also want Tesla to fail. I wonder why that is.

A Alvarez, If, as Elon hopes, shareholders are willing to sell 30% of their shares at $420, then it will only take $11 billion to buy them all. And if they are willing to sell 25% it will cost $6.8 billion. Would it really be that difficult to raise between $6.8 and $11 billion when the Saudis just invested around $2.5 billion on the open market after practically begging Tesla to issue new shares for them to buy? Elon and Tesla refused the Saudis offer several times already which forced them to buy 5% of Tesla on the open market. They probably want to buy more, so this all makes sense. After talking to Musk again and again about it, he's finally, "considering" accepting their offer. It's not like Tesla went to them begging for them to invest in Tesla so that they could raise capital. What has apparently happened is that the Saudis have been begging Tesla to let them invest. Given this, any reasonable person would believe that funding is secured. I supposed this means that Musk is a reasonable person.

A Alvarez, "Nobody had agreed to his price or to fund his plan yet." Really? You know that for sure? Were you in the meeting with Musk and the Saudis or something?

So, was Musk in his car on the way to the airport for a flight on his private jet to Nevada when he sent the tweet? Or was he at home tripping on acid with Azealia Banks? It seems like it would be real easy to check the airports to find out if Musk flew to Nevada shortly after sending the tweet. Don't you think? https://www.nytimes.com/2018/08/16/business/elon-musk-interview-tesla.html "That morning, Mr. Musk woke up at home with his girlfriend, the musician known as Grimes, and had an early workout. Then he got in a Tesla Model S and drove himself to the airport. En route, Mr. Musk typed his fateful message." Azealia Banks' story is absolutely ridiculous. Do you really believe Musk has time to spend tripping on acid before he heads to work? If he's got that much spare time, why would he be so stressed?

I bet that if the SEC tried to put Elon in jail there would be riots in the street.

@0:39, is he saying that it's illegal for a company or CEO to let people know that they're thinking about taking the company private?
