Due care means death happened while doing brain surgery due to the instrument accidentally touched other tissues if brain and bled internally. This is not negligence. Here is example of negligence : death happened because the doctor used contaminated toilet bowl and that caused infection and death. This is negligence. Both cases so far the medical practitioners have been evading law. People are creating unwanted hype for each am every reforms.

No. It is clear that whether negligance if present will be weighed only by an officer appointed by court as per rules of the bill passed by govt. Here all investigation will be done by team constituting members of ima ( Indian medical council or authorities or teams containing doctors authorized by ima).

Still the hospital managed to escape the law by using advocates money power. They went unpunished. This is negligance. Now for eg if this law comes into force if suppose similar incident happens again then the law will investigate this case with help of not quacks but ima authorized authorities only.

@fr2k11ster successfully removed in coimbatore royal care hospital but stent fixing is only available in appolo hospital. Stent fixing ceased his fate. The stent was contaminated while fixing it. It developed infection.

I told that while fixing stent in heart or brain an infection happening thereupon without bleeding is negligence of doctor only. Indian medical council itself agrees this. If suppose bleeding happened during surgery this is okay if its brain but infection.wothout bleeding due to stent fixing alone, this couldve been easily avoided by doctor if due care was taken.

What about accidental usage of toilet bowl for injecting anemia during cesarean surgery and as a result the acid content in the bowl got injected into her body and condition got serious. The hospital some how patched up all their wrongs and evaded law using good advocates. So do you defend this under non negligence also or what?

My uncle told me how an Indian dr highly qualified got poor remarks in UK during world conference in practicals. He also told me that stent infection caused immediate to surgery before discharge from hospital is negligance of doctor only yet they will cover up all issues in court.

@andrewdavid8656 ok I gave up on stent fixing in brain already. But there are many negligence caused by doctors these people here are hiding it either knowinging with vested interests or unknowingly. This is known case in coimbatore sheela hospital adjacent to powerhouse the doctors conducted cesarean surgery to a patient in which anemia was administered in a toilet wash dish tray it contained acid used for cleaning toilet. The patient suffered intestinal damage. Intestine got stuck inside as a result. This happened in sheela hospital and the hospital is still functioning. If it is in usa means the licence of that hospital wouldve been cancelled then and there. 2) quality of education in medicine in India is poor. You do bds ( bachelor of dental care) you cannot practice in usa without doing dds ( bachelors course) 3) a well reputed doctor highly qualified from india went to UK international conference and did practicals there and got scolded by nurse. His only mistake is he did his work as well as the work of nurse in her absence which is against ethics of the profession there. In west the nurse can sue the doctor if the doctor interfere into work of nurse and do things wrong unlike in India here the doctors look upon the nurse like some inferior person this is because our society is still not developed. To bring development only the govt is making new reforms to make professionals more responsible towards their work. 4) You go to any doctor india they will prescribe you antibiotics unnecessarily. This is the poor quality of medical education in India. My cousin in usa had ligament tear for that the doctors did not prescribe even 1 antibiotic. 5) an orthodontist ( mds) vist our clinic every month once. In 60 minutes he would finish putting appliances for 1 patient. But the quality of his treatment you will vomit, he uses same gloves for next patient just by wiping in towel without washing also so we stopped him. But this is the quality of doctors in India if you do this in usa you will not work anymore there as your license will get cancelled next moment you land up in jail. In India students aim is complete medicine simehow get a degree and soon open up clinic and start earning only this is in mind of most doctors. You dont get quality research orientated prescription here in India. A research orientated prescription means they will take time to study past history of medical records and give advice based on textual research. This most doctors never do this in India (except professors), they will straight away prescribe you antibiotics and push you away unlike in USA and west there they will give you an appointment only if there is real need. @santhosh2513 see. Taking precautions and going wrong is different vs negligence is different. The current law is only against "negligence" and loss of life due to negligence and NOT against loss of life due to "non negligence" "SSI is a thing that we cannot prevent even after taking 1000 precautions" this comes under "non negligence" this is okay. The new law is not against this. The new law is only against 1) negligence 2) loss of life due to a surgery done by doctor who knew 100% that the patient will not survive the surgery and they did not communicate the warning/ seriousness to the patient's guardian. 3) unnecessary cost expensive lengthy surgery recommended or done to patient in a time where a simple non-surgical non-expensive treatment wouldve solved the issue for the patient.

This is there in every profession (not just doctors) and there is a need to stop all those things. Why agitate against stop of malpractice? "yes cause you people blame doctors for even trying...so we save ourself first" whole world has these law why india alone should be an exception? "Sometimes" the Doctors recommend too many drugs unnecessarily to patients from a particular chemist&druggiststore why? Answer = you get commission from that store monthly. @scorpio3058 but if you do bds in India which is bachelors of dental science, you cannot work as a doctor in west usa UK etc. Plaab usmle are all different. But you cannot clear usmle and work as a doctor in usa with bds or by doing post graduation in usa with bds degre. If you want to work there you have to do dds ( graduation in dental science) then only you can work there. See Indian doctors ( doctors from India) are seen like waste unless you graduate from there. Its exactly like how Indians itself view doctors/ engineers of karnataka/ Russia like kangaroo doctors. Same way the US UK Europe skeptic towards doctors from India. But if you graduate from there then then it is different. Now it is bit different Indian doctors treated better after this current govt came but yet they consider the Indian doctors "qualitatively poor" because here in India you can do things that you cannot do there and get protection by law. Here you will get protection from law by being negligent but you cannot get protection of law by being negligent in west. So they never recruit people with bds degree or Indian doctors unless you graduate from there even if you clear usmle or plaab.

For eg doctors council is I think it is ima; legislative council now judiciary and bar council are trying to snatch and control from hands of legislatiore; like wise we have a council engineering lecture etc This council wants to control things in their ways. They started working for their benifit alone today and not for peoples benifit. It is trying to become like illuminati of this country. These council pretends like mediator in between ordinary people and elevted govt but now they want to sit and control everything that will benifit only for them. So for this they dont want punishment for being negligent. But this will affect ordinary people. As a result the quality of education is going down.

Here Indian army is main reason. They only wanted joint venture. Joint venture takes time to choose a partner based on negotiation of money etc. Then finally usa came forward and contract was fixed.
