How could McConnell overturn Article II Section 2 of the Constitution in the Merrick Garland nomination without a single legal or constitutional argument in an unprecedented way?. Obama should have sued McConnell for this action but stood by like a deer in headlights. No one in these years have given a solid legal reason for McConnell's actions. If McConnell continued being such a D head Obama could have also relied on English Common law where silence is agreement, and since the Senate waived their constitutional duty, sworn in Garland, and then let McConnell sue if he unhappy with this course of events. There is case law that backs such actions.
