  2.  @Jon-fh6nf  Prosecution's going point out the fact that he deliberately put the other driver in direct harm by break checking, which is illegal because it can make people crash, and that he is NOT acting in self defense because he continued to fire after the other car passed him and posed no credible threat to him. Just as a reminder, if somebody attacks you, then runs away, shooting them in the back is murder. So the question will be whether or not firing in a blind panic can still be called "self defense" after the point where he's no longer in credible danger. At the very least, he'll probably get reckless endangerment

He deliberately put the other driver in danger with brake checking, an illegal action that can carry up to 2 years in prison for deliberately trying to make people crash, and drew his gun BEFORE the other driver posed a threat to him. It's going to be pretty easy to show intent to cause harm. Furthermore, self defense only allows you to PREVENT harm to yourself or others (or in some places to prevent immediate theft of property). This right ENDS once the situation is defused and your attacker ceases being a threat. You cannot continue shoot people in the back as they drive away from you. Unless he is literally firing backwards out his back window, it is NOT self defense. If I attacked you, then ran away, you would to to prison if you shot me in the back. Retaliation is not self defense. Sorry, Eric Popper is an attempted murderer. He is a danger to society and should not be allowed on the road or to have a gun ever again. It's a shame that the 8th amendment prevents us from chopping off fingers.
