  1.  @Luther79345  Freedom of speech is not unlimited. It generally does not apply to speech that causes direct harm such as blackmail, defamation, and threats, and it doesn't to speech that puts others in the path of harm. If members of the trial and their families are receiving death threats, which they will be, it will be ruled that the gag order is warranted for their safety.

  2.  @Luther79345  No, it's not. The Supreme Court has repeatedly ruled that speech may be restricted in circumstances and was not intended as "you can say anything you want". Also, I don't think you want "all speech is protected", because that means a person could publicly advocate for the assassination of a politician's family, or display pornography on those giant TVs in Times Square and that would be protected speech too.

  3.  @Luther79345  Freedom of Speech refers to expression, not physical speech. Otherwise, you could arrest somebody for political artwork, whether it's drawing, painting, sculpture, pottery, performance art, or any other non-verbal, non-written media. Also, it will apply to all forms of expression invented in the future. By the way, a form of non-verbal expression that has been ruled as protected speech is flag burning.

  4.  @Luther79345  .... flipping somebody the bird isn't illegal. You'd get in trouble in the same situations as other verbal types of swearing because obscene content is not protected. Disorderly conduct is based on bother or potential harm to others. Also, you can't enforce "speech refers only to verbal speech", because you will have a 14th amendment Equal Protection challenge within hours if you do not include non-verbal communication because that's discriminatory to those that cannot talk. Would you like to be the man whose law career is ruined by trying to argue to the Supreme Court that the 1st Amendment doesn't apply to the deaf? You're a hundred years too late, bud.
