  1. That. And as someone pointed out in this comment section: they might use the records to lower the worth of the kids. They might try to argue that a child with behavioural issues would never havd amounted to much in live (would not have held down a job with a high income) and that that means they should be worth less in compensation.

  3. They are worth less when Remington has to pay. They will argue that some of the kids would not have been able to get high paying jobs - and therefore are worth less than others. They are going to treat this from the point of 'loss of future earnings', saying that those kids would have not been able to provide for themselves and their families. It is an argument tried before. The cruelty of doing this in the month of September might be lost on Remington, but not on their legal team - as it is a strategy lawyers tried to employ after 9/11.
