I will politely disagree. I consider his actions to be excessive. Being loud and obnoxious does not rise to the use of physical Force.

@jdearing46 there are no reports of this man hitting anyone on the train. He had been arrested for prior assault of someone. That is a very distinct difference.

@ThatNorwegianGuy- this man is facing charges because there is no reasonable to substantiate a claim of self-defense. The victim was not armed. Had not touched anyone. And law enforcement resources were available. There was no imminent threat.

@Dream-Eternal87 this is why people get into road rage incidents. It's also why police dealing with emotionally disturbed people is always usually a bad one. Police are a hammer being used on every nail. This man needed his medication and a sandwich. Not being stuck in a Chokehold for 15 minutes. The actions on this train would have been Justified and no charges made in the case if there was clearly a present danger or an act of violence in progress. The man had no weapon. Had not assaulted anyone. And the option of calling the Transit Police seems not to be used. I think they frankly jumped the gun here. He would have just continue to the next train car. like he did the day before and the day before that.

@Dream-Eternal87 speaking of minors. Hear in Philadelphia at least two teams have been shot dead on Septa trains or buses and the last two months. Over basically minor altercation.

@Dream-Eternal87 I think the grand jury kind of saw it the same way. There is certainly a line where action is required. I don't think the guy crossed that line? You want to call 911? You want to push the button for the train operator? You want to record the incident? All are reasonable courses of action. Being a verbal nuisance and hungry doesn't cross that red line. He whips out the suicide vest and starts yelling, "Allah Akbar!" I will be first to mag dump on the guy.

I will politely disagree. Non hero. I think his actions were not warranted. I have yet to see anything that demonstrates that the rantings of a homeless man required forcible restraint. And that his use of force is excessive and led to death. THus,I think the grand jury made the correct decision. Is there a point where such actions are Justified? Yes. However based on the information so far, I do not think they reach that level.

@crystalray2907 So your rationale is we need to assault every homeless person in the Subways in New York who shouts at you? Is he holding a bomb to his chest and shouting Allah Akbar? If so, feel free to engage. Otherwise give the guy a sandwich and let him be on his way. Which would diffuse the situation with no dying.🥪

@grizzlygrizzle his statement says nothing about defending any girlfriend. And none of the reports say anything about him laying hands on anyone. The eyewitnesses say this was a verbal altercation.
