The UN Security Council -- including its permanent members Russia and China -- was fully onboard with the Afghan op. So should Putin, Jiang Zemin, Hu Jintao and Xi Jinping also be charged as accessories to an illegal war? Why have no charges been levelled against any of those on your list? Because there was no case? Try to make one.
