  2. It's blatantly unconstitutional, but I don't think there's a single statute that specifies what the remedy or punishment is when the U.S. Government violates the U.S. Constitution. SCOTUS can say whatever it wants. The executive branch can say "Shove it!" and there's nothing short of a revolution that could make them stop. Andrew Jackson had a confrontation with SCOTUS, before. People say they're the law of the land, but the judiciary has no real power, other than to say "stop" and f***-all if the executive ignores them or defies them.
