  1. I think Autopen is a red herring, but Joe's fitness to sign ANYthing, when the DOJ decided not to prosecute him because he was mentally incompetent to stand trial, is in great doubt. Furthermore, the preemptive pardons shouldn't stand up, because you can't pardon someone preemptively. Presidents shouldn't be able to come in, commit crimes, and then pardon everybody involved before anybody has been indicted, let alone convicted. To me, those pardons are just an arrow pointing straight at the people who SHOULD be investigated and prosecuted.

  2. No one has been pardoned prior to being convicted of a crime. These pardons are more confessions than pardons.
