  1. Yes, they open themselves up to EEOC and discrimination lawsuits. Under law, ESG is illegal if they're discriminating on the basis of immutable characteristics rather than merit. I hope that shareholders start suing these companies for failing in their fiduciary responsibilities by hiring people on any basis other than merit and performance.
