Not sure how the system in Serbia is, but if the PM is out of his party, then the voters that did vote on that party voted not for a solitary independent PM, so it would be electoral deceit. In case of him being president (different title) then I think it would be electoral deceit as well, because the president is not with an elected party any more. I think that he is basically fired and has to go.
