If it's true then in the very long duration of the battle of Bakhmut they could have retreated or surrendered at any time until even 2 days ago when he allegedly said that (no more pows, 'no more' indicates that they did take pows so far then). It seems that a battalion surrendered in the last week for example. Also in a final stage of an urban/trench warfare battle like this, maybe taking pows is more or less impossible.
