@Protestdog Exactly. The 1st Amendment protects UNpopular speech. That's my point. If I'm a Christian in a neighborhood of staunch atheists, this cross could be considered & it's still in my direct periphery. Your right to swing your arms stops at my face. Right? But this is a little different because it's in the neighbors' direct periphery. I could see if the woman lived out in some high desert in NV. But she's not. She's in the nation's 2nd densest city.

Just to be the devil's advocate here, I must ask an important question. What if I'm an atheist & I live across the street? That's offensive to me. What about that guy in Idaho who had the Klan snowman? That noose was an attractive nuisance but the snowman itself was on the guy's front lawn. Just sayin'...

@Protestdog "That's why we call it America" is a poor premise. Yes, free speech policy is designed to protect unpopular speech. Yes, my right to swing my arms ends at your face. But it's a little different here because her neighbors don't have much choice here; they can't "change the channel". Dig? That's why I'm challenging the conclusion. If I fart, you can walk away or hold your breath. But it's not like the neighbors can just pick up & leave. Just sayin'...

I'm paying a house note someplace. I have a right to some relative piece. What if that cross were on fire & there were SS flags flying by the door. It's NOT a weak argument. And the notion that someone can just pick up & move isn't realistic; especially not in this moment in American history. Again, I'm being the devil's advocate. There's a reason you can't play your radio at a certain volume. There's a reason you give the city a heads up when you throw a big party at your house. Dig?
