No. Assault can be touching someone when they don't want you to. Reasonable fear of injury isn't the only criterion. If I spray you with a hose, that's assault. Like I told another person on this post, I poured a beer on my lunatic, stalking ex-gf. My friend, a policeman with a JD, informed me that it was considered assault. As for your premise of it being a prank, I don't disagree. But that doesn't mitigate doing it. It's a big deal to that guy. It's also very lame.

To the contrary, it's considered a simple assault. I've read the law. You don't go around touching people when they don't want you touching them without any legal recourse. And it's true that police don't know every law, but we no longer live in an age or a world where anyone can say, "I don't know". It's assault, mate. Ask any cop.

It actually IS a physical assault. Any time you touch a person without consent, it's assault. It's not like he touched him to get his attention. also, because it's seen on youtube doesn't make it acceptable. It's not necessarily a ridiculous law. It's an observation of basic limits. It doesn't have to be an aggressive way for it to be assault. If I say, "don't touch me", that means you better respect the boundary or we're gonna have a problem. I can't really say whether or not a pop in the face was lousy.
