This is a more nuanced issue than as presented here. If you run a theater where someone is yelling "fire" but there is no fire, do you have let him continue to endanger everyone's safety? Of course not. In fact, it would be immoral to do so. The damage Jones was doing by harassing people that were already victims was obvious. That harassment IS against the law. As a believer in free speech, I think the hard part is in cases where it is not so obvious and we should err on the side of allowing speech. People who are wrongly censored should have a right to sue AFTER the fact, just like people who are harassed or defamed. The law is capable of making these distinctions.
