  5. Maybe for the other disclosures, but not for those within the scope of the original discovery response, which had previously been withheld. The info outside the scope wasn't relevant and wasn't used ie. It had no effect. In other words the only "malpractice" was in the initial noncompliance and not the subsequent transmission of records. I'm not a litigator but that seems obvious.

  7. Wrong. They were obligated to turn that over during discovery. Hiding the info is the unethical part.
