The IRS does no such thing. I am absolutely SHOCKED at the flagrant ignorance displayed in this thread about how Treasury enforces tax laws. As soon as they detect a potentially fraudulent use of an SSN, the legitimate holder is issued an identity theft PIN by mail to their address of record and is told to use it for all filings. Refund claims lacking the PIN are disallowed unless the taxpayer can otherwise prove their identity.

To claim the EITC, among other requirements, you must "...Have been a U.S. citizen or resident alien for the entire tax year; and Have a valid Social Security number (not an ITIN) for yourself, your spouse (if filing jointly), and any qualifying children on your return..." Also, the IRS is full of veterans (there's a hiring preference) who tend to be conservative. Your post has as much actual knowledge behind it as my claiming that you're a baby-eating cannibal whose basement is full of tiny human skeletons.

@Unicron6 They cannot lawfully claim it. Of course some FRAUDULENTLY claim it! If you have evidence of any that do so, you should report them to the IRS at www.irs.gov. You might be entitled to an award.
