 @anthonypolonkay2681 State have control over their state election process. So they have the right, no, the duty to see if it is illegal for the state to certify someone that is not qualified to be elected. Just like it would be their duty to not put somebody on the presidential ballot who is younger than 35 or not a natural born citizen. States are still bound by the 14th amendment. Seriously, I swear you guys love trying to defend a serial fraudster even if it violates the constitution... And then you probably want to yammer on about how the constitution is so important and demonrats don't respect it. But, hey, you're in luck, because Trump ALSO has 2 criminal federal indictments for the documents as well as J6. So you'll be happy to hear those federal offenses are the ones that can send him to prison.

Impeachments are political, they are not law proceedings. There is no judicial oversight of an impeachment. Congress writes laws, they don't judiciously interpret them after the fact- that's the judges job to look at the law of the 14th Amendment and see if it applies.

 @FirstLast-sw1gx The electoral college isn't democratic 🤦 it's funny that you talk about the constitutional republic but then people around here keep forgetting that the 14th amendment is a part of the Constitution. I understand it's a representative democracy but it's a long-touted right-wing talking point to tell Lefties "it's not a democracy, it's a republic"... But now I guess they don't like to hear that same line right back at them.

No, it's not on hold. It's set for right now, but it can be appealed and judged by the Federal Supreme Court but it has to be done before Jan 5th. He has to formalize the appeal first.
