  1. Worth noting that the MCA itself is very likely unconstitutional; the 1886 case of United States v. Kagama, which upheld it, would almost certainly be decided differently were it to occur today (in which case only tribal courts would have jurisdiction to hear cases arising from crimes on reservation land).
