  1. Why do the courts even give deference to assessments and determinations by government entities in the first place? If you're in court and the prosecutor asks why you killed your neighbor, you can't just say "I determined that it was necessary to kill them", you have to justify your decisions and actions to the court. There's no reason why government entities shouldn't have to justify their own decisions and determinations in open court. Oh, and we also need a law to prevent the government from submitting classified information as evidence in court, and to automatically declassify any classified information required as evidence by a party opposing the government in court.

  2.  @balzarinemythus50 ...but once that evidence has been provided, it's on you to rebut it (for instance, by providing a reasonable justification for having killed the victim). You're perfectly within your rights to refuse to testify... but doing so when the prosecution's made its case effectively throws the case to the prosecution.
