DOJ and now, SCOTUS made that stuff up out of thin air. Congress also dropped the ball of course, because they are a political body. The authors of the Constitution didn't expect people to read and interject meanings that weren't in the document already. If changes needed to be made, they were meant to be made by Amendment alone. They are not to be made by the DOJ or the Supreme Court, ever!
