Before European settlers arrived, the Americas were inhabited by diverse Indigenous nations with their own governments, territories, and legal systems. These groups were sovereign in their own right, and the land was not “empty” or unclaimed. From the perspective of Indigenous peoples, European settlers encroached upon their lands without their consent.
European powers justified settlement through legal frameworks like the Doctrine of Discovery, a principle established by European monarchies in the 15th century. According to this doctrine, lands not ruled by Christians were considered “terra nullius” (land belonging to no one), and European nations claimed the right to colonise them. However, this doctrine disregarded the sovereignty and rights of Indigenous peoples and is now widely recognised as unjust and a product of colonialism.
It’s true that the area now known as the United States was not a unified nation in the modern sense at the time of European colonisation. However, the absence of a Western-style nation-state doesn’t imply that the land was ungoverned or unowned. Indigenous societies had their own political systems and sovereign territory.
