Wherever the case goes, they'll have to address this judge's reasoning. The old rationale for approving it, it was just another tax, doesn't hold anymore since the individual mandate was eliminated by Trump. What other premise for its validity could there be? The Court should uphold, and tell congress to try again; that's the way it's done, traditionally. And, no, the Court cannot overturn WITHOUT taking the case; not taking the case MEANS the lower court is upheld. What they could try to do is invalidate Trump's order to eliminate the "tax"--now THAT would be a can of worms worthy to behold!
