  1. The original "problem" was the states' implementations being discriminatory. The rationale for federal involvement is still pretty sketchy, though. It did provide a legal avenue for redress at the state level through such "civil rights" legislation. It's not PC to argue that black people are too stupid to benefit from good education, so sub-standard education is ok for them. But that's been a common attitude, especially in the south.
