  13. The trouble with the FISA court is imbalance: there is only the prosecution represented; nobody represents the "defense" interests. So, the judge is at a disadvantage, since his usual function is to referee the battle between the two sides, and now there is only one side--the judge would have to assume an adversarial stance toward the prosecution, which is...untenable, in order to introduce some of the lacking balance...Ain't happening...
