If the FBI decides not to call for an indictment, they will have to explain their reasons to the public. Since the public (at least those citizens paying attention) is already aware that gross negligence has been committed and that the Clinton Foundation is not what it's meant to seem, what kind of explanation could the FBI give that didn't ring false? That, in turn, would besmirch the FBI, an eventuality that James Comey (or his many dedicated investigators) would be highly unlikely to accept. This implies that a call for an indictment is inevitable. Whether the DOJ chooses to refuse to prosecute is, in political terms, irrelevant for Clinton. The damage will have been done. The FBI should act before the Democratic National Convention, not during or after it, in the interests of political stability. The Democrats ought to know for sure that their front runner is deemed guilty of criminal behavior and that the FBI has in fact called for her indictment. They shouldn't be placed in the position of nominating Clinton and having her indicted during the convention, or while campaigning for president. That would constitute an injustice to the Democrats and would hand the election to Donald Trump. That said, there's still the sticky problem of the large swathe of Clinton followers who apparently have lost the their power of reason and will continue to believe she should be POTUS..
