  1. It will be a Federal lawsuit. The law isn’t clear, but taking possession (arrest) triggers responsibility to the police. If they just left her on the street and she died, they have no responsibility.

  2. Legally, the police don’t have any responsibility to do anything. Civilly, they “might” have responsibility because they took her into custody.
