  1. That BAC reading must be way off: 0.12 is bad, but not usually staggering drunk. The caveat is the time: 5 drinks in 1 hour gets a 150lb man to that reading. It's 6 drinks in 2 hours. My guess is he drank quickly. And, yeah. The dude didn't hit the break. All new cars have computer readings ie blackbox. They should be able to figure it out.
