He has to allow it, but I hope he doesn't agree to the conditions the defense wants -- no prosecutor present and no court reporter (so no transcript). If you're trying to prove there was a procedural error made in how the instructions were presented to the jurors, you'd certainly want a transcript of what the juror said they were told. Normally< I'd just think they are trying to mount a vigorous defense by looking at all avenues, but one of Chesebro's attorneys (Aurora) was actually admonished by the court for harassing grand jurors in an adjacent county (DeKalb) at their homes in the past. The jurors had to go so far as to get a protective order against him. A court reporter should at least be present just to protect the jurors, assuming any jurors agree to speak. Then, the defense cannot claim in a subsequent hearing that a juror said X, Y, Z. Perhaps, they're trying to send a message to the upcoming trial jurors to be careful how they vote. It was a bit laughable when Powell s attorney, Rafferty, claimed several times that the prosecution has not given him the specific discovery evidence he's asked for and finally went on to elaborate that "Someone (not Powell) was sent a letter with an invitation to take voting machines in Coffee Co., " but the prosecutor won't give it to him. Then, he said the reason he knows the letter exists is because he heard about it on CNN! Obviously, Powell hasn't seen it because he doesn't know who it was even supposedly sent to, so, if it exists, it's not relevant for Powell's defense.
