Whether he is a citizen or resident is irrelevant. The Bill of Rights makes no mention of citizens or residents. It speaks only of the people, meaning that ANYONE in this country is covered by the rights detailed in it. This racist pretense about citizenship is the right wing's eternal dodge to deny those rights to whoever they don't like.
