@TDMFAN This 'driveway' isn't legally a roadway?? Under the Road Traffic Act, he's coming from a path not accessible to the public. The curb curves round because the people who created the block got permission from the council to construct a vehicle crossover. If it was an actual road then the cyclist would 100% be at fault, but in this case, he crossed a public footway. The cyclist shouldn't have been on the pavement and is liable for that but at the same time, the driver of the car himself said he could not see because of his bonnet and the brick wall so he should've been driving even slower. He did not take appropriate action to reduce risk.

@TDMFAN Look at application guidance for vehicle crossovers, it DOES include curving the kerb out of the way, Hertfordshire County Council has the most detailed pdf. If the road is publically accessible and probably named it would be a different story. You're yet to demonstrate that the driver didn't cross a public footway/footpath. You previously said the path which the driver exited from was a road, the Road Traffic Act tells us that a road is 'any highway to which the public has access', the public don't have access to this garage/highway. The driver himself admitted his negligence when he said he couldn't see past his bonnet/brick wall.
