I think the issue with the death penalty is not that it makes society no better than the killer: it's that it makes society worse. A person may kill for a variety of reasons, crimes of passion, personal gain, derangement, but the state kills while, allegedly, operating from a rational position, with no external coercion. In the criminal code, premeditated murder carries the harshest penalty, and this is the kind of murder the state reserves for itself to perpetrate, as it is the wont of any authority to exempt itself from certain of its laws. We should not allow the state, a giant, fallible apparatus of immense power, to have the ability to kill citizens it deems unworthy.
