In regards to the two cases versing Google in the first case I don't believe it should have been ruled in Google's favor as I can imagine being able to see the picture on the thumbnail instead of in the website would cause the website itself to have reduced traffic and compensation. The second case I believe is fine as people are just looking for phrases comic book rather than the entirety of the book.
