  2. There is a much simpler solution. ECJ could rule Poland's constitution is not in agreement with EU treaties it signed and as a result its membership is temporarily suspended as primacy of EU treaties is a core requirement for EU membership. For duration of the suspension EU funds would be stopped and Poland would lose voting rights in the EU. This mechanism would allow to punish Hungary as well.
