Charges never give jurors “an out”. Each felony law is very specific as to what it is an how it applies. If a crime doesn’t fit the specific definition, then you cannot find someone guilty of it. The prosecutors simply don’t know where this might fit and when it comes back as manslaughter, which I think it will, the DA doesn’t want to be blamed for not giving a Murder 3 option.

I see many references to slots here. Sorry folks, that’s not the answer here. Airports all around the world have suspended slot minimums during the pandemic, recognizing that there is little need for flights. There are two actual reasons not to cancel a flight on a 777, like the one used on this flight: 1 - There may be many people booked on the aircraft’s return, in this case from Orlando to London and 2- Despite being empty on the main deck, the plane is likely very full below (cargo). 777s are extremely good at carrying cargo pallets and air freight is very well priced during this pandemic. Most airlines have been flying passenger planes just with cargo on board.

It literally said he stopped the train at every stop and let people in/out, but there is a hell of a lot more stuff that goes into properly operating a train. You have to know its mechanical and electrical systems, federal and state regulations, MTA procedures and emergency procedures. What would have happened to the passengers if there was some unforeseen emergency?

What I can tell you (and this is another fact) is that something doesn’t need to be on a website to be a fact, nor is everything on the internet a fact. In this case, I’ve seen this man’s case at the DA’s office and it is a FACT that he has had no proper training to be able to handle non-routine situations. It is in his legal case and is an issue brought up in his charges. It is how he endangered lives. And no, you have NOTHING to bust that.

Professional psychiatrists who actually evaluated him decided he’s out of control and dangerous. This man has been evaluated by many psychiatrists, including ones ghat work for his own lawyer. They all agreed he needs long-term in-patient psychological treatment. You... a random Youtube character who has nothing to do with him or anything else are contradicting it. I assure you, I don’t look stupid enough to trust your “opinion” over their professional assessments. Not that you actually care about what anyone thinks or says, I’m sure.

He is (fact) dangerous. He does (fact) things he is not allowed or actually trained to do. I don’t know what you’re an engineer of or for, but I have a couple of friends who are train operators for the MTA and both know of this guy well. They both went through an extensive training program, mechanical, procedural and operational, and while driving a train smoothly is indeed gained by experience, they went through weeks of classroom training before ever stepping a foot into a driver’s cab. They also had to get licensed. The fact is that someone with this man’s condition cannot help himself or his actions. He needs serious psychiatric help for that. The fact is that someone with that condition does not make rational decisions. Those aren’t my personal opinions. Those are facts. Your opinion of his possibly being safe or misunderstood are simply opinions based on assumptions, not facts.

@NightWolf3342 Are you insane or. something? Honestly, are you? Did you watch the video? Read about the case? Also, not “how are you sure they didn’t teach him?” No! They aren’t instructors. The impetus is to prove he is safe, not to prove he is unsafe. It is to prove that he is safe. That’s how safety and law works. That’s how jobs work, how certification, qualification and licensing works. You don’t get to do a job until you prove you’re unsafe. You have to demonstrate your knowledge and safety BEFORE you get to do the job. The fact that you don’t get those basic concepts at all means you’re done in this conversation.
