@Jordan-ce7sf Actually they can. The DPS, the DA’s office and the DoJ can all subpoena him. Judges aren’t the only ones with such powers. He is required to provide information as per his duties. If he chooses to pleas the 5th Amendment it won’t help him at all as all of his decisions were made in public, with lots of witnesses and police procedures are always documented in detail. You’re mixing up Miranda rights of an accused. He’s not being accused. There is an investigation into what happened. If he refuses to cooperate he CAN be charged with obstruction of justice. You should ask for a refund of your Cracker Jacks JD degree.

From the Texas state penal code: “(d) A person acts with criminal negligence, or is criminally negligent, with respect to circumstances surrounding his conduct or the result of his conduct when he ought to be aware of a substantial and unjustifiable risk that the circumstances exist or the result will occur. The risk must be of such a nature and degree that the failure to perceive it constitutes a gross deviation from the standard of care that an ordinary person would exercise under all the circumstances as viewed from the actor's standpoint.”

He can’t legally not be sworn into city council. He was elected. He can be impeached though.

@fatman2772 Right now it looks likely like criminal negligence for failure to discharge his public duties resulting in the death of 21 individuals. It’s literally at least 21 felony counts.
